NIS-2
The NIS2 Directive (Network and Information Systems) specifies the minimum cybersecurity requirements that EU countries must meet for critical infrastructure. Its aim is to enhance cybersecurity levels in the European Union and strengthen international cooperation in combating cyber attacks. NIS2 has been in force since January 16, 2023, and must be transposed into national law by Member States by October 17, 2024. The new directive affects approximately 30,000 companies in Germany.
A draft bill of the German law implementing NIS2 (NIS2Umsetzungsgesetz) is now available and is currently in the coordination phase. Subsequently, it still needs to go through the legislative process.
It is advisable for companies to start addressing the issue now rather than waiting for final adoption. The rollout of necessary measures requires planning, preparation, and resources for implementation and maintenance. What changes?
The tightening of the regulations compared to NIS or existing national regulations mainly concerns the obligation to have effective cyber risk management and to collaborate with existing and newly established governmental institutions.
Above all, the liability situation for companies becomes more stringent, but notably, there is also the introduction of clear personal liability for the executive level and in Germany for managing directors if corresponding measures are not implemented.
